What happens to my driver’s license after a New York DWI arrest?
www.ithacadwi.com A driver’s license is a privilege, basically a permission. New York suspends this privilege to drive within the state at the initial appearance of your DWI case. If you have a license from another state your privilege to drive in New York will be suspended. This is called a “suspension pending prosecution” and it is only if you have a test result of .08 BAC or higher. Your attorney can apply for a “hardship privilege” at the arraignment. Under New York law a hardship hearing must occur within 72 hours of the arraignment. A Hardship License only allows privileges “to and from” school, work, or medical care.
